Terms of Service

1. Acceptance of Terms

By accessing or using Splittamo (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of material changes.

2. Description of Service

Splittamo is a group food ordering platform that allows users to create shared ordering sessions with their teams, offices, or friends. Each participant places and pays for their own order individually. Splittamo connects users with restaurants and facilitates payment processing via Stripe.

3. User Accounts

3.1 Registration

You must register for an account to use most features. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your password.

3.2 Eligibility

You must be at least 16 years old to create an account. By registering, you confirm that you meet this requirement.

3.3 Account Security

You are responsible for all activity that occurs under your account. Notify us immediately at legal@splittamo.com if you suspect any unauthorized use.

4. Ordering and Payments

4.1 Order Sessions

Order sessions are created by space admins. Once you place an order and complete payment, the order is confirmed. Deadlines set by the session creator are binding.

4.2 Payments

All payments are processed securely by Stripe. By placing an order, you authorize Stripe to charge your selected payment method. Splittamo charges a platform fee of 3% per transaction on top of the order amount.

4.3 Refunds

Refund requests are handled on a case-by-case basis. If a restaurant cancels your order or there is a service failure, you may be eligible for a full refund. Contact us at legal@splittamo.com within 24 hours of the issue.

4.4 Restaurant Payouts

Restaurant owners receive payouts via Stripe Connect after deduction of the platform fee. Payouts are subject to Stripe's payout schedule and terms.

5. Restaurant Owners

Restaurant owners using Splittamo agree to:

  • Provide accurate menu information including prices and availability.
  • Fulfill orders in a timely and accurate manner.
  • Complete Stripe Connect onboarding to receive payouts.
  • Comply with all applicable food safety and business regulations.
  • Not discriminate against any user when fulfilling orders.

Splittamo reserves the right to suspend or remove restaurant accounts that do not meet these requirements or that receive consistent complaints from users.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to any part of the Service.
  • Create fake accounts or impersonate other users.
  • Submit fraudulent orders or payments.
  • Abuse the invite system to spam users.
  • Scrape, crawl, or extract data from the Service without permission.
  • Interfere with or disrupt the integrity of the Service.

7. Intellectual Property

The Splittamo name, logo, platform, and all associated content are the intellectual property of Splittamo. You may not use, reproduce, or distribute any content from the Service without prior written permission.

By submitting content (such as restaurant names, menu descriptions, or profile information), you grant Splittamo a non-exclusive, royalty-free license to use that content to operate the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that defects will be corrected. Splittamo is not responsible for the quality, accuracy, or availability of food orders placed through the platform.

9. Limitation of Liability

To the maximum extent permitted by law, Splittamo shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service, including but not limited to lost profits, data loss, or service interruptions, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid to Splittamo in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Italy.

11. Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 7–10 survive termination.
